Man guilty of sexual assault sentenced to 18 months house arrest

A Revelstoke man will spend 18 months under house arrest after being convicted of sexual assault.

David Galen Anders, 43, was charged with sexually assaulting a woman during an incident which occurred in his home on March 8, 2018.

The woman, as well as witnesses for the Crown, cannot be named under a court-ordered publication ban.

Anders pleaded not guilty to the charges during court proceedings on March 7 and 8, 2019. in his May 8 decision, Provincial Court Judge R. Dennis Morgan determined the complainant, who had consumed alcohol during the evening in question, was unable to consent to any sexual activity. He found Anders guilty, stating he found the complainant’s testimony both solid and credible.

A sentencing hearing was held in Revelstoke court on Nov. 6. Judge Morgan placed the following sentencing conditions on Anders:

-18 months of house arrest. For the first nine months Anders is required to be in his home from 2 p.m. to 11 a.m. each day. For the remainder of the 18 months, Anders must remain in his home between 11 p.m. and 7 a.m.

-Surrender a sample of his DNA under a primary DNA order

-Attend programs such as treatment or counselling as required by his supervisor

Anders will also be registered with the National Sex Offender Registry for a period of 10 years. Established under the Sex Offender Information Registration Act, the National Sex Offender Registry is a national database that contains information on convicted sex offenders.
